These Terms of Service (“Terms”) govern your access to and use of the website nexon-digital.com and any mobile applications, software, products and services (together, the “Services”) provided by Nexon Digital FZCO (“Nexon Digital”, “we”, “us” or “our”), a company registered with the International Free Zone Authority (IFZA), Dubai, United Arab Emirates.
By accessing or using the Services you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you are under the age of majority, you may use the Services only with the consent of a parent or legal guardian.
2. Accounts
Some Services may require an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Please notify us promptly at [email protected] of any unauthorised use.
3. Licence to use our apps
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install and use our applications for your personal, non-commercial use. Where an app is obtained from a third-party store (such as the Apple App Store or Google Play), the store's terms also apply, and the store provider is not responsible for the app or its support.
4. Purchases and subscriptions
- Some features may require payment, including in-app purchases or auto-renewing subscriptions. Prices are shown before purchase.
- Payments made through app stores are processed by the respective store and are subject to its billing, cancellation and refund policies.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period through your store account settings.
- Except where required by applicable law or store policy, payments are non-refundable.
5. Acceptable use
You agree not to:
- use the Services for any unlawful, harmful, fraudulent or abusive purpose;
- copy, modify, reverse-engineer, decompile or create derivative works of the Services, except as permitted by law;
- interfere with or disrupt the security or operation of the Services;
- upload content that infringes the rights of others or is offensive, defamatory or illegal;
- use bots, scrapers or automated means to access the Services without our permission.
6. User content
You retain ownership of content you submit through the Services. You grant us a worldwide, non-exclusive, royalty-free licence to host, store and display that content solely to operate and improve the Services. You are responsible for ensuring you have the rights to the content you submit.
7. Intellectual property
The Services, including all software, designs, text, graphics, logos and trademarks, are owned by or licensed to Nexon Digital FZCO and are protected by intellectual property laws. Nothing in these Terms transfers any of these rights to you.
8. Client projects
Where we provide software development or digital services to business clients, the scope, fees, deliverables and ownership of work product will be governed by a separate written agreement, which prevails over these Terms in case of conflict.
9. Third-party services
The Services may contain links to or integrations with third-party websites and services. We are not responsible for their content, policies or practices.
10. Disclaimer
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability and non-infringement, to the fullest extent permitted by law. We do not guarantee that the Services will be uninterrupted, secure or error-free.
11. Limitation of liability
To the maximum extent permitted by applicable law, Nexon Digital FZCO shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill. Our total liability for any claim relating to the Services shall not exceed the amount you paid us for the Services in the twelve (12) months preceding the claim, or USD 100, whichever is greater.
12. Indemnity
You agree to indemnify and hold harmless Nexon Digital FZCO and its officers, employees and partners from any claims, losses or expenses arising from your misuse of the Services or breach of these Terms.
13. Suspension and termination
We may suspend or terminate your access to the Services at any time if you breach these Terms or if required by law. You may stop using the Services at any time.
14. Changes
We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Any dispute shall be subject to the exclusive jurisdiction of the courts of Dubai, unless mandatory consumer protection laws in your country provide otherwise.
